Lexus Vehicle Speed Control: Accelerator Pedal

Lexus is recalling about 19,647 vehicles over a problem with the vehicle speed control. The accelerator pedal could temporarily become stuck in a partially depressed position rather than return to the idle position.

What the defect is

Toyota is recalling certain model year 2006 and 2007 lexus GS300 and GS350 all wheel drive (AWD) vehicles. There is a possibility that the plastic pad embedded into the floor carpet may interfere with the operation of the accelerator pedal.

What could happen

The accelerator pedal could temporarily become stuck in a partially depressed position rather than return to the idle position. A stuck accelerator pedal may result in unintended and sustained vehicle speeds and make it difficult to stop increasing the risk of a crash.

What gets fixed

DEALERS WILL MODIFY THE PLASTIC PAD ON THE FLOOR CARPET FREE OF CHARGE. THE MANUFACTURER HAS NOT YET PROVIDED AN OWNER NOTIFICATION SCHEDULE.

Your rights

A safety recall repair is free. Under US federal law the manufacturer must fix a safety defect at no cost to you — no charge for parts, labor or diagnosis — whether or not you are the original owner. A dealer cannot charge you for recall work, and cannot require you to have bought the vehicle from them.

That entitlement is not unlimited. It applies where the vehicle was first sold less than 15 years before the recall was announced — 5 years for tires. Past that a manufacturer may still do the repair free of charge, and many do, but they are no longer obliged to. This recall was reported on 24 February 2011.
