What the defect is
BMW of North America, LLC (BMW) is recalling certain 2020 MINI Hardtop 2-Door Cooper, Cooper S, and JCW vehicles. The rear side trim panels may have been assembled without a crash pad. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard (FMVSS) number 214, "Side Impact Protection."
What could happen
Without a crash pad, rear seat passengers would have an increased risk of injury in the event of a side impact crash.
What gets fixed
MINI will notify owners, and MINI dealers will install crash pads, free of charge. The recall began October 11, 2019.

Your rights
A safety recall repair is free. Under US federal law the manufacturer must fix a safety defect at no cost to you — no charge for parts, labor or diagnosis — whether or not you are the original owner. A dealer cannot charge you for recall work, and cannot require you to have bought the vehicle from them.
That entitlement is not unlimited. It applies where the vehicle was first sold less than 15 years before the recall was announced — 5 years for tires. Past that a manufacturer may still do the repair free of charge, and many do, but they are no longer obliged to. This recall was reported on 28 August 2019.
