What the defect is

Turtle top is recalling certain model year 2005 through 2009 spirit (mfsab terra transport) multi-function school activity buses manufactured from october 27, 2004 through july 31, 2009, equipped with freedman seating company seat restraint barriers. The affected seats contain a steel plate with incorrect gage of steel which fails to conform to the requirements of federal motor vehicle safety standard no. 222, "school bus passenger seating and crash protection."

What gets fixed

TURTLE TOP WILL NOTIFY OWNERS AND A REPAIR KIT ALONG WITH INSTRUCTIONS WILL BE PROVIDED FREE OF CHARGE. OR, IF THE OWNER PREFERS, REPAIRS WILL BE MADE BY A TURTLE TOP DEALER. THE SAFETY RECALL BEGAN ON SEPTEMBER 14, 2010.

Your rights

A safety recall repair is free. Under US federal law the manufacturer must fix a safety defect at no cost to you — no charge for parts, labor or diagnosis — whether or not you are the original owner. A dealer cannot charge you for recall work, and cannot require you to have bought the vehicle from them.

That entitlement is not unlimited. It applies where the vehicle was first sold less than 15 years before the recall was announced — 5 years for tires. Past that a manufacturer may still do the repair free of charge, and many do, but they are no longer obliged to. This recall was reported on 7 September 2010.
