What the defect is
BMW of North America, LLC (BMW) is recalling certain model year 2016-2017 MINI Clubman vehicles manufactured August 19, 2015, through July 14, 2016. The side curtain air bags for the front seat occupants may deploy in the intended positions in the event of a crash. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard (FMVSS) number 226, "Ejection Mitigation."
What could happen
If a side curtain air bag does not inflate as intended in the event of a crash, there is an increased risk of injury to the front seat occupants.
What gets fixed
BMW will notify owners, and dealers will modify the driver and passenger side curtain air bag covers, free of charge. The recall is expected to begin September 12, 2016.

Your rights
A safety recall repair is free. Under US federal law the manufacturer must fix a safety defect at no cost to you — no charge for parts, labor or diagnosis — whether or not you are the original owner. A dealer cannot charge you for recall work, and cannot require you to have bought the vehicle from them.
That entitlement is not unlimited. It applies where the vehicle was first sold less than 15 years before the recall was announced — 5 years for tires. Past that a manufacturer may still do the repair free of charge, and many do, but they are no longer obliged to. This recall was reported on 25 July 2016.
