What the defect is
Mercedes-Benz USA, LLC (MBUSA) is recalling certain 2023 EQE 350, S580e, 2022-2023 EQS 450, EQS 580, 2022 AMG EQS 53, and EQS 450+ vehicles. The high-voltage battery monitoring system software may not alert the driver of a battery malfunction. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 305, "Electric-powered vehicles: Electrolyte Spillage and Electrical Shock Protection."

A high-voltage battery monitoring system that does not alert the driver of a battery malfunction may increase the risk of an injury.
What gets fixed
Dealers will update the battery management system software, free of charge. Owner notification letters were mailed beginning August 18, 2023.

Your rights
A safety recall repair is free. Under US federal law the manufacturer must fix a safety defect at no cost to you — no charge for parts, labor or diagnosis — whether or not you are the original owner. A dealer cannot charge you for recall work, and cannot require you to have bought the vehicle from them.
That entitlement is not unlimited. It applies where the vehicle was first sold less than 15 years before the recall was announced — 5 years for tires. Past that a manufacturer may still do the repair free of charge, and many do, but they are no longer obliged to. This recall was reported on 2 May 2023.
