What the defect is
Nissan North America, Inc. (Nissan) is recalling certain model year 2006-2010 Infiniti M35 and M45 vehicles manufactured April 4, 2004, through October 5, 2010. Over time, the accelerator pedal sensor signal may deteriorate resulting in the output of an incorrect signal causing the engine to go into fail-safe (limp home) mode.
What could happen
In this fail-safe mode, throttle valve deposits may cause the engine to stall when the vehicle is coming to a stop or at idle, increasing the risk of a crash.
What gets fixed
Nissan will notify owners, and dealers will replace the accelerator pedal assembly and reprogram the engine control module, free of charge. The recall is expected to begin during November 2013.

Your rights
A safety recall repair is free. Under US federal law the manufacturer must fix a safety defect at no cost to you — no charge for parts, labor or diagnosis — whether or not you are the original owner. A dealer cannot charge you for recall work, and cannot require you to have bought the vehicle from them.
That entitlement is not unlimited. It applies where the vehicle was first sold less than 15 years before the recall was announced — 5 years for tires. Past that a manufacturer may still do the repair free of charge, and many do, but they are no longer obliged to. This recall was reported on 26 September 2013.
