What the defect is

Mercedes-Benz USA, LLC. (MBUSA) is recalling certain 2013-2017 vehicles due to a software fault that may cause the date and time for the emergency call system (eCall) to differ from the actual date and time, potentially relaying an inaccurate vehicle location. What could happen

An inaccurate vehicle location may delay emergency responders, increasing the risk of injury.

What gets fixed

MBUSA has initiated an Over the Air (OTA) remote update. MBUSA will also notify owners, and dealers will check software for a successful OTA or update the communication module software as needed, free of charge. The recall began December 23, 2019.

This recall is fixed by a software update. The manufacturer reports the remedy can be delivered over the air, so affected vehicles may not need a dealer visit. Confirm with the manufacturer before assuming yours has received it.

Your rights

A safety recall repair is free. Under US federal law the manufacturer must fix a safety defect at no cost to you — no charge for parts, labor or diagnosis — whether or not you are the original owner. A dealer cannot charge you for recall work, and cannot require you to have bought the vehicle from them.

That entitlement is not unlimited. It applies where the vehicle was first sold less than 15 years before the recall was announced — 5 years for tires. Past that a manufacturer may still do the repair free of charge, and many do, but they are no longer obliged to. This recall was reported on 1 November 2019.
